1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and PropertyPilot B.V. ("PropertyPilot," "we," "our," or "us") regarding your use of our AI-powered property management platform and related services.
By accessing or using PropertyPilot, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.
2. Description of Services
PropertyPilot provides an AI-powered property management platform designed for vacation rental owners and property managers. Our services include:
- Automated guest communication and response generation
- Property management system integrations
- Analytics and performance insights
- Knowledge management and learning tools
- Multi-property portfolio management
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. Account Registration and Security
To use PropertyPilot, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information remains current and accurate
You must be at least 18 years old to create an account. You may only create one account per person or entity.
4. Acceptable Use Policy
You agree to use PropertyPilot only for lawful purposes and in accordance with these Terms. You may not:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Upload or transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems
- Use our services to compete with us or develop similar products
- Reverse engineer, decompile, or attempt to extract source code
- Use automated systems to access our services without permission
- Share your account credentials with third parties
5. Subscription and Billing
Subscription Plans
PropertyPilot offers various subscription plans with different features and limitations. Plan details and pricing are available on our website and may be updated periodically.
Payment Terms
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method for recurring fees
- Failed payments may result in service suspension or termination
- Price changes will be communicated with 30 days' notice
Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You remain responsible for all charges incurred before cancellation.
6. Intellectual Property Rights
Our Rights
PropertyPilot and all related materials, including software, designs, text, graphics, and trademarks, are owned by us or our licensors. You receive a limited, non-exclusive license to use our services for their intended purpose.
Your Content
You retain ownership of content you provide to PropertyPilot. By using our services, you grant us a license to:
- Process and analyze your data to provide our services
- Generate AI responses based on your property information
- Improve our algorithms using aggregated, anonymized data
- Store and backup your data for service continuity
7. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We implement appropriate technical and organizational measures to protect your data and comply with applicable data protection laws, including GDPR where applicable.
8. AI Services and Limitations
PropertyPilot uses artificial intelligence to generate automated responses and insights. You acknowledge that:
- AI-generated content may not always be accurate or appropriate
- You are responsible for reviewing and approving all communications
- We do not guarantee the performance or results of AI features
- You should maintain human oversight of all guest interactions
- AI responses are suggestions and should be customized as needed
9. Service Availability and Support
We strive to maintain high service availability but cannot guarantee uninterrupted access. Our services may be temporarily unavailable due to:
- Scheduled maintenance and updates
- Technical issues or outages
- Third-party service provider issues
- Force majeure events
We provide customer support through various channels as outlined in your subscription plan. Response times may vary based on your plan level and the complexity of your inquiry.
10. Disclaimers and Limitations
PropertyPilot is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, whether express, implied, or statutory, including:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, completeness, or reliability of content
- Uninterrupted or error-free operation
To the maximum extent permitted by law, our total liability for any claims related to these Terms or our services shall not exceed the fees you paid in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless PropertyPilot and its affiliates from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.
12. Termination
Either party may terminate your account and access to our services:
- For any reason with 30 days' notice
- Immediately for material breach of these Terms
- For non-payment of fees after notice and opportunity to cure
- If required by law or regulation
Upon termination, your access will cease and we may delete your data according to our data retention policy.
13. Governing Law and Disputes
These Terms are governed by the laws of the Netherlands. Any disputes will be resolved through binding arbitration in the Netherlands, except for:
- Claims for injunctive relief
- Intellectual property disputes
- Small claims court matters
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of our services after changes constitutes acceptance of the updated Terms.
